ONLINE COURSE ON HUMAN RIGHTS & BUSINESS

The course is implemented in the framework of Ankawa International’s Social Transformation Program for Nigeria.

II. ABSTRACT

The Online Course on Human Rights & Business is an intensive international traineeship program destined to empower human rights and environmental defenders worldwide. The course approaches human rights & business from a practical and theoretical perspective in order to deliver adequate tools for advocacy, research and litigation.

III. ATTRACTIVENESS

The Online Course on Human Rights & Business is framed to provide capacity-building to prospective participants and/or institutions working in human rights and development. Participants will have the opportunity to interact with professors in a forum for mutual empowerment. Participants will also have the opportunity to discuss and to share experience with the Ogoni Community from Nigeria.

IV. ACADEMIC CURRICULA

1st Module. Dr. Elizabeth Umlas
January 8:

• Opening remarks of Mr. Amilcar Romero.
• Introduction to Business and Human Rights: origins, antecedents to the UN framework.

January 9:

• UN Guiding Principles on Business and Human Rights: key concepts, three pillars (including access to remedy), human rights due diligence, grievance mechanisms.

January 10:

• An overarching look at selected accountability mechanisms: laying the groundwork for students to understand barriers to «access to remedy», judicial and non-judicial mechanisms and [time permitting] touch on the proposed international treaty on BHR.

January 11:

• Extractive industries and indigenous people’s rights: intro to the issues specific to this industrial sector and this group of stakeholders.

January 12:

• An overview of emerging legislation relevant to BHR: mandatory human rights due diligence, mandatory corporate reporting on human rights issues.

2nd Module. Ms. Charity Ryerson
January 15:

• Testimonies from the Ogoni’s Representatives.
• Introduction to business and human rights in the global legal system
• Rome Statute, ICC and corporate liability
• Corporate liability in regional human rights courts and international tribunals
• Variations in legal regimes covering transnational activities across domestic legal systems

January 16:

• Kiobel and its legacy: Analysis of Kiobel decision and Alien Tort Statute cases decided since 2012

January 17:

• The history of Shell in the Ogonilands.
• Overview of Ogoni political and legal system.
• History of oil exploration activities and community response.
• Corruption accusations against Shell.

January 18:

• The fight for the survival of the Ogoni people: Discussion of the strategies members of the Ogoni community have pursued around the globe.

January 19:

• The future of business and human rights litigation in domestic courts: remaining gaps and emerging strategies.
• Final Remarks of Mr. Amilcar Romero.

V. EVALUATION METHODOLOGY

The final exam will take place on January 22, 2018 and it will last 2 hours. It will be qualified on the basis of 20/20 points. According to Ankawa International’s Internal Rules on Academic Excellence, only students with 14/20 will receive an official certification; otherwise, students will receive only proof of participation.

The evaluation criteria are:

• 80% Final Exam.
• 20% Participation (attending courses and participation in sessions and in the forum).
